Judge Rules in Favor of Bike Accident Victim in Steel Road Plate Case

The judge will allow a jury to decide if two construction companies were negligent in causing a bike rider’s injuries by leaving an unramped steel plate in the roadway.  The cyclist chose Steve Vaccaro to represent him.

Justice Kathryn Freed of New York Supreme Court denied the motions of two construction companies to be dismissed from a case brought by a cyclist who crashes on an improperly-ramped steel plate. New York City law requires that steel road plates be ramped around the edges with asphalt so as to ensure a “smooth ride,” but this is often not done.  Mr. Vaccaro’s client had a bicycle accident and was injured on an improperly-ramped plate as shown.  Judge Freed held that a jury would be permitted to decide whether the two construction companies were negligent in causing the bike rider’s injuries.
